Sub: Claimants of OYO HOTELS AND HOMES Pvt. Ltd.
Dear Member,
This refers to the public announcement (attached herewith) by Insolvency Resolution Professional Shri Keyur Jagdishbhai Shah inviting claims from operational creditors of OYO subsequent to the order dated 30.3.2021 passed by NCLT Ahmedabad (attached) initiating the Corporate Insolvency Resolution Process.
One Mr. Anuj Tejpal approached the NCLAT against the above order dated 30.03.2021 of NCLT and the formation of CoC (Committee of Creditors) is stayed by order dated 8.04.2021 till the next date but the CIRP is still continuing and the matter is yet to be settled or closed. In the NCLAT the plea which has been taken is that dues payable to the Operational creditor are payable by the sister concern namely “My Preferred Transformation and Hospitality Pvt. Ltd. (CMTH) and not by the Corporate Debtor. The matter is now listed on 16.04.2021 before NCLAT. In the interim, the RP is inviting claims and thus all claims may be submitted on or before 15th April 2021.
As per the advisory, members may submit their claim in respective forms as per provisions of the CIRP Regulations & as mentioned in the public announcement, as available on IBBI website, before 15.04.2021.
Relevant claim form B can be downloaded from https://ibbi.gov.in/home/downloads.
All claimants, need to fill out Form B (attached) for the purposes of submission to the Interim Resolution Professional of Oyo Hotel and Homes Pvt. Ltd., and email to cirp.oyohotels@gmail.com on or before 15th April 2021. The claim amounts should include Interest till 1st April 2021.
We hereby inform aggrieved hoteliers to take opinion and submit their claims immediately in proper forms.
For the said purpose, the claimants will require the following documents to be attached along with Form B and emailed to cirp.oyohotels@gmail.com :
- Copy of complete agreement executed between you/ your company/firm with Oyo Hotel and Homes Pvt. Ltd/ Alcott Town Planners Pvt. Ltd.
(In case you have executed more than one agreement, please provide copy of the agreement which is covering the period of unpaid dues).
- In case the claimant is a company i.e. xyz Pvt. Ltd or xyz Ltd: Then provide master data of company from MCA portal and certificate of incorporation. Provide board resolution authorizing one director/employee to sign and submit claim.
Provide Aadhaar Card/ Pan Card /Voter Id Card of such Director/Employee authorized
In case the Claimant is a Partnership Firm
- Provide certificate of registration of partnership, if any
- Provide authority letter on letterhead of partnership where one partner is being authorized to sign and submit claim by remaining partners
- Provide Aadhaar Card or Pan Card or Voter Id Card of all the partners of the firm
In case claimant is a Proprietorship Firm
- Provide GST certificate of proprietorship
- Provide Aadhaar Card or Pan Card or Voter Id-Card of proprietor
In case claimant is an Individual
- Provide Aadhaar Card or Pan Card or Voter Id-Card of individua.
